1. Reporting Claims of Copyright Infringement

If you fail to comply with all the requirements of Section 512(c)(3) of the DMCA, your DMCA Notice may not be effective.

Note: If you knowingly misrepresent that material on the Website is infringing, you may be liable for damages (including attorneys' fees) under Section 512(f) of the DMCA.


2. Counter-Notification Procedures

If you believe that material you posted on the Website was removed or disabled by mistake or misidentification, you may file a counter-notification ("Counter-Notice") with us. Pursuant to the DMCA, your Counter-Notice must include substantially the following:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled, and the location where it appeared before removal or disabling.
  • Adequate contact information by which we can reach you (name, postal address, telephone number, and, if available, email).
  • A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled due to mistake or misidentification.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district where your address is located (or any judicial district where the Website may be found if you reside outside the U.S.), and that you will accept service of process from the person who provided the DMCA Notice (or their agent).

Under the DMCA, we may restore the removed content if the party filing the original DMCA Notice does not file a court action against you within ten (10) business days of receiving your Counter-Notice.

3. Repeat Infringers

It is our policy, in appropriate circumstances, to disable and/or terminate the accounts of users who are found to be repeat infringers. If we conclude that a user repeatedly posted infringing material, we may permanently ban them from using the Site or any related services.
